These Terms of Service govern your use of the website located at https://enrichment.kids and any related services provided by Enrichment.kids.

By accessing https://enrichment.kids, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing this website or using any other services provided by Enrichment.kids.

We, Enrichment.kids, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page and revise the “Last updated” date above. Any changes to these Terms of Service will take effect immediately from the date of publication. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

1. Using Enrichment.kids

What We Offer

Enrichment.kids is an online marketplace that connects parents and guardians (“Customers”) with enrichment activity providers (“Providers”) who offer camps, classes, and other programs for children (“Programs”). Enrichment.kids facilitates discovery, registration, and payment for these Programs but is not itself a provider of any Program. We act as a marketplace intermediary—not as a party to any transaction between a Customer and a Provider.

Who Can Use the Service

To use Enrichment.kids, you need to be capable of entering into a legal contract. That means you comply with all applicable laws—local, state, national, and international. If you’re under 13, you can’t use our service; it’s against these terms. If you’ve previously been banned by Enrichment.kids, you’re also not eligible to use the service.

This Service is intended for use by adults (parents, guardians, and enrichment providers). Children should not access or use Enrichment.kids directly.

Our License to You

We grant you a limited, non-exclusive license to use Enrichment.kids for your personal, non-commercial needs. All rights not specifically given to you are reserved by Enrichment.kids. We can revoke this license at any time, for any reason, including no reason at all.

Creating an Account

Your Enrichment.kids account allows you access to various features we might offer. We have different account types, such as for Enrichment Providers. If you’re representing an organization, you need to have the authority to enter into this agreement on behalf of that entity.

You can either create an account yourself or, if you’re an Enrichment Provider, we might set one up for you. You can claim or request deletion of the account by emailing us at [email protected].

Managing Your Account

Don’t use someone else’s account without permission. When you set up an account, provide true and complete information. You’re responsible for all activity on your account. Please secure your password. If there’s any unauthorized use of your account, notify us immediately at [email protected].

Your profile settings control how you interact with the service. If you give us your email address, expect to receive service-related notices and updates, some of which are legally required.

2. Rules for Using the Service

You agree not to:

  • Copy, distribute, or disclose any part of the service.
  • Use automated systems to access the service in a way that burdens our servers more than individual human usage would.
  • Send spam or unwanted emails.
  • Compromise the system’s security.
  • Overburden our infrastructure.
  • Upload harmful data like viruses.
  • Harvest personal information.
  • Use the service for commercial solicitation.
  • Pretend to be someone else or misrepresent your identity.
  • Disrupt the service’s proper working.
  • Access the service in unauthorized ways.
  • Circumvent any protective measures on the service.

Enrichment.kids reserves the right to use automated systems, including artificial intelligence and other tools, for content verification, quality assurance, and platform integrity purposes.

We can change or stop offering the service without prior notice. We can also limit your access for any reason, including violation of this agreement. If your account is terminated, you still have to adhere to these terms.

3. Interactions with Other Users

You’re solely responsible for your interactions with other Enrichment.kids users. While we may monitor disputes, we’re under no obligation to do so. We’re not liable for any interactions or any actions (or non-actions) by other users.

4. User-Generated Content

Our platform allows you to upload content such as profile details, comments, and other types of information (collectively referred to as “User-Generated Content”). We don’t claim ownership over what you create; it remains your property. However, by uploading this content to Enrichment.kids, you grant other users the ability to view, modify, and share your content based on your settings and this agreement. If you’re an enrichment provider using our platform, this is also subject to the Enrichment Provider Agreement. We reserve the right, although we are not obligated, to remove any User-Generated Content according to our discretion.

When you upload User-Generated Content, you agree not to include material that:

  • Poses a risk of harm or danger to people or animals
  • Could damage property or cause other forms of loss
  • Is harmful or exploitative toward children
  • Is unlawful, dangerous, or contributes to illegal activities
  • Contains information that could be considered invasive of privacy, hateful, or discriminatory
  • Contains false or misleading information
  • Infringes upon third-party intellectual property rights

For the purpose of this agreement, “Intellectual Property Rights” encompasses patent rights, copyrights, and any other forms of intellectual property under any applicable laws or jurisdictions.

By uploading User-Generated Content, you affirm that:

You have the explicit consent from all identifiable persons in the content for their information to be used as intended by this Service and Agreement.

Neither the content nor its use by Enrichment.kids violates any laws or infringes upon the rights of any third party, including intellectual property rights and privacy rights.

Enrichment.kids can use your User-Generated Content without being liable for any kind of fees or charges under any legal or collective agreements.

To your best knowledge, all provided User-Generated Content and other information is accurate and complete.

Enrichment.kids is not responsible for any User-Generated Content that you or any other user uploads. You alone are responsible for your content and its consequences.

5. Licensing of User-Generated Content

When you upload User-Generated Content on Enrichment.kids, you provide us with a non-exclusive, royalty-free, transferable, and perpetual license to use, modify, and distribute your content. This includes reproducing it, listing information about it, translating it, and creating derivative works from it, across various forms of media and technologies. The same content can be accessed, used, and shared by other users of the platform, as allowed by the functionality of our Service and under the terms of this Agreement (and the Enrichment Provider Agreement, if applicable).

Ownership of Content

Except for content you upload, all materials on the Enrichment.kids platform, such as software, text, images, and other proprietary material (collectively referred to as “Enrichment.kids Content”), are the exclusive property of Enrichment.kids or our licensors. You are not allowed to use, modify, copy, or distribute the Enrichment.kids Content in any way not explicitly permitted by this Agreement. Your unauthorized use is strictly prohibited.

Platform Content and Automated Tools

Some content displayed on Enrichment.kids, including but not limited to program descriptions and listing information, may be generated or enhanced using automated tools. While we strive for accuracy, such content is provided for informational purposes only. You should verify program details, schedules, pricing, and other material information directly with the relevant Provider before making enrollment or payment decisions. Enrichment.kids is not liable for inaccuracies in automated or algorithmically generated content.

Feedback and Suggestions

You’re welcome to provide comments or ideas about how to improve our services (“Ideas”). By submitting Ideas, you’re agreeing that Enrichment.kids is not obligated to compensate you, and we are free to use or disclose your Ideas without any restrictions.

6. Payments, Reservations, and Refunds

Marketplace Role

Enrichment.kids facilitates payment transactions between Customers and Providers but is not the seller of any Program. When you purchase a registration or enrollment through our platform, your transaction is with the Provider, not with Enrichment.kids. We use Stripe, a third-party payment processor, to process payments. By using our Service, you agree that you have read and accept Stripe’s Terms of Service (https://stripe.com/legal) and Privacy Policy (https://stripe.com/privacy).

Types of Transactions

The platform supports multiple types of payment transactions, including but not limited to: one-time purchases for Program registrations or enrollments, recurring monthly billing arrangements where charges are processed automatically on a regular schedule, and invoices issued by Providers for specific enrollments or services. The type of transaction and its terms will be clearly presented to you before you complete any purchase or authorize any payment.

Reservation Holds

When you initiate checkout for a Program, a temporary reservation hold is placed on the selected spot(s). This hold expires automatically if payment is not completed within the allotted time. Expired reservation holds release the spot(s) back to general availability. Enrichment.kids is not responsible for spots that become unavailable due to expired reservation holds.

Payments to Providers

When you make a reservation or enrollment with a Provider, you commit to paying for that transaction. You allow us to charge the total cost to your chosen payment method. If there’s a pricing error, we will either bill you for the difference or cancel the transaction and refund you.

Recurring Monthly Billing

Certain Programs may use a recurring monthly billing arrangement. By enrolling in a Program that uses monthly billing, you authorize Enrichment.kids and its payment processor to automatically charge your stored payment method on a recurring basis (typically on the first of each month) for the applicable billing period. Monthly charges are billed in arrears, meaning you are charged for the prior month’s enrollment after the service period has occurred.

When enrolling in a monthly-billed Program, you may be required to provide and save a payment method as a condition of enrollment, even if no payment is due at the time of enrollment. By saving your payment method, you expressly authorize Enrichment.kids and its payment processor to charge that payment method for future recurring charges associated with your enrollment.

Monthly billing amounts are determined by the Provider and may be prorated based on the dates you were enrolled during a given billing period. Monthly billing for a particular enrollment continues until the associated Program session ends, the Provider ends your billing arrangement, or your enrollment is otherwise terminated. You will receive advance notice before each recurring charge is processed.

Stored Payment Methods

If you save a payment method on Enrichment.kids, it is stored at the account level and may be used for any applicable transaction on the platform, including recurring monthly billing across multiple Providers. You can view and update your stored payment method through your account dashboard at any time. You are responsible for ensuring your stored payment method remains current and valid.

Failed Payments and Past-Due Balances

If an automatic payment fails, Enrichment.kids may attempt to process the payment again during a grace period. You will be notified by email of any failed payment and given the opportunity to update your payment method or pay the outstanding balance. If payment is not resolved after the grace period, the outstanding invoice will be marked as past due.

A past-due balance does not automatically cancel your enrollment or stop future invoices from being generated. You remain responsible for all charges incurred during any period in which you were enrolled, regardless of payment status. The Provider retains the right to manage your enrollment independently, including ending your billing arrangement or removing your enrollment if payment is not resolved.

Provider-Initiated Billing

Providers may initiate billing relationships, send enrollment invitations, or issue invoices to you through the platform. By completing checkout for any Provider-initiated transaction—including enrollment invitations—you agree to the pricing and payment terms presented at checkout. Provider-initiated billing follows the same payment processing, fee, and refund terms described in this section.

Refunds and Credits

Refund and cancellation policies are set by individual Providers and may vary. It is your responsibility to review the Provider’s refund and cancellation policy before completing a purchase. Enrichment.kids facilitates refund processing but does not control or guarantee refund decisions made by Providers.

Platform service fees and payment processing fees charged by Enrichment.kids are non-refundable unless the Provider elects a full refund that includes those fees. Please contact the Provider directly regarding their specific refund and cancellation policies.

Providers may, at their discretion, issue credits to your account that can be applied to future invoices from that Provider. Credits are provider-specific, non-transferable, non-withdrawable, and can only be applied to charges from the issuing Provider.

Chargebacks and Payment Disputes

If you believe a charge is incorrect, please contact the Provider directly or reach out to us at [email protected] before disputing the charge with your bank or card issuer. If you file a chargeback or payment dispute with your bank or card issuer for a transaction you authorized through the Service, you remain responsible for the underlying payment obligation and any fees or costs resulting from the dispute. Enrichment.kids reserves the right to suspend your account, terminate active enrollments, or pursue collection of amounts owed in connection with disputed charges that are determined to have been validly authorized.

Accurate Information and Taxes

Make sure all information you provide for transactions is accurate and current. You’ll be responsible for all charges made through your payment method at the current prices. Any applicable taxes related to transactions will also be your responsibility.

California Residents

For California residents, complaints can be reported to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs. 7. Children’s Information

Enrichment.kids is a service designed for use by adults—specifically parents, guardians, and enrichment activity providers. We do not knowingly allow children under 13 to create accounts or use the Service directly.

In the course of registering a child for a Program, you may be asked to provide information about your child, such as their name, age, and other details requested by the Provider’s registration form. By providing this information, you represent that you are the child’s parent or legal guardian and that you consent to the collection and use of your child’s information for the purpose of facilitating enrollment in the selected Program.

Information you provide about your child during registration is shared with the relevant Provider to facilitate enrollment and program administration. Providers are solely responsible for their handling of participant information in accordance with applicable laws. Enrichment.kids does not sell children’s personal information or use it for advertising or marketing purposes unrelated to the Service.

If you believe that information about a child under 13 has been submitted to Enrichment.kids without proper parental consent, please contact us immediately at [email protected] and we will take steps to remove such information.

8. Registration Form Data

Certain Programs may require you to complete registration forms as part of the enrollment process. These forms are created and managed by Providers and may request information such as emergency contacts, health or medical information, allergies, dietary restrictions, or other details relevant to your child’s participation.

By completing a registration form, you acknowledge and agree that the information you provide will be shared with the relevant Provider for the purposes of program administration and participant safety. Enrichment.kids transmits this information to Providers but does not control how Providers use, store, or protect registration form data. Providers are independently responsible for handling this information in compliance with applicable privacy laws and regulations.

You should direct any questions about how a Provider handles registration form data to that Provider directly.

9. Privacy and Electronic Communications

Privacy Policy

By using Enrichment.kids, you consent to the collection and use of your personal data as outlined in our Privacy Policy.

By creating an account or making a purchase on Enrichment.kids, you consent to receive electronic communications from us, including but not limited to: account confirmations, purchase receipts, enrollment confirmations, cancellation and refund notifications, waitlist updates, billing and invoice notifications, payment failure alerts, upcoming charge reminders, and other transactional messages related to your use of the Service. These communications are part of your relationship with us and may not be opted out of while you maintain an account or have active enrollments.

We may also send you service-related announcements when we believe it is necessary to do so, such as notices about changes to these Terms, our Privacy Policy, or platform functionality.

Security

We make an effort to protect your personal information, but no system is 100% secure. You acknowledge that you provide your information at your own risk.

Enrichment.kids includes links to websites, services, or promotions that we don’t own or control, including Provider websites and third-party services. We’re not responsible for these third-party sites or their content. If you choose to visit one of these links, you’re doing it at your own risk, and our terms and privacy policies won’t apply there. We won’t be held liable for any issues arising from your use of these third-party sites. Any transactions between you and these third-party sites are your responsibility, not ours.

11. Your Responsibilities

You agree to protect Enrichment.kids and its associates from any legal claims, losses, or expenses (including legal fees) arising from your use of our service. This also includes any violation of these terms, our privacy policy, or laws, as well as any harm you may cause to another user. This clause extends to the situation where someone else uses your account, with or without your consent.

12. No Guarantees

We provide Enrichment.kids “as is” and “as available.” We make no promises about the reliability or availability of the service, nor do we guarantee that it will be error-free or secure. We’re not responsible for any harm to your computer or loss of data that might occur due to downloading content from our service.

Enrichment.kids does not guarantee the quality, safety, legality, or suitability of any Program listed on the platform. We do not endorse or verify any Provider or Program, and we make no representations about the accuracy or completeness of any listing information. Your decision to enroll in a Program is made at your own risk and discretion.

Some jurisdictions have laws that might give you additional rights; this agreement doesn’t change those rights unless the laws allow it.

13. Limits on Our Liability

To the extent the law allows, Enrichment.kids won’t be held responsible for indirect losses or damages (like loss of profits), even if we’ve been advised that they might occur. In the unlikely event that you would bring a claim against us, our liability would not exceed the greater of $100 or the amount you’ve paid for our services in the twelve (12) months preceding the claim. We’re also not responsible for issues that arise from unauthorized access to our service or your account. The terms of this section apply whether the claim against us is based on contract, tort, or any other legal theory, and they apply even if we’ve been advised of the possibility of such a claim. This limitation of liability is based on laws and regulations of Sonoma County, California, USA.

Accessibility Compliance

Enrichment.kids provides tools and services to facilitate the creation and management of camps and classes. We are committed to ongoing efforts to improve accessibility. However, we do not guarantee that any content uploaded by providers or the services offered through our platform comply with accessibility laws (such as the Americans with Disabilities Act or similar legislation in other jurisdictions). It is the sole responsibility of the providers to ensure that their content, services, or any materials shared on or through Enrichment.kids comply with all applicable accessibility standards and legal requirements.

Enrichment.kids shall not be held liable for any claims, damages, or lawsuits arising from accessibility-related legal obligations that providers may face as a result of using our platform.

Jurisdiction and Compliance

Enrichment.kids is operated from the United States and is not intended for use outside of this jurisdiction. If you access or use our service from other locations, you’re responsible for following U.S. and local laws. The service is not available to residents of countries under U.S. embargo or foreign entities restricted by the U.S.

Applicable Laws

By using our service, you agree that Enrichment.kids is solely based in California. Our service is considered passive, meaning it doesn’t subject us to jurisdiction in places other than California. The internal laws of California will apply to this agreement, our Privacy Policy, and the Service Provider Agreement, without any conflicting state laws affecting this. Any arbitration will be under the Federal Arbitration Act. The United Nations Convention on Contracts for the International Sale of Goods doesn’t apply here. If we ever need to go to court for intellectual property issues, that will happen in Sonoma County, California.

Arbitration

If you have a disagreement with Enrichment.kids, please contact us first at [email protected] to try to resolve it informally. If we can’t sort it out within 60 days, either of us can move the dispute to binding arbitration through JAMS, Inc., according to their expedited procedures. The arbitration will happen in Sonoma County, California, unless we both agree to another location. Depending on whether you are a business or an individual using the service for non-commercial purposes, the fees for JAMS and the arbitrator will differ, as will the potential for fee waivers and costs being awarded. However, you are not obligated to go through arbitration and can bring a claim in a small claims court if that suits your needs better. Any court with the right authority can enforce the arbitration decision.

Group Lawsuits and Jury Trials

You agree to only bring claims against us as an individual, not as a member of a group or class action lawsuit. Both of us waive the right to a jury trial for any claim.

15. General Terms

Assigning Rights

You can’t transfer your rights under this agreement, the Privacy Policy, or the Service Provider Agreement to someone else. We can.

Notifications and Agreement Changes

Enrichment.kids may send you notifications through different means, like email or our website. We also have the right to update this agreement and other related agreements. Make sure you review this regularly, as your continued use of our service implies you agree to any changes.

Entire Agreement and Its Parts

This Terms of Service, along with any amendments and any other agreements like the Privacy Policy and Service Provider Agreement, is our complete agreement. If any part of this agreement is ruled invalid by a court, the rest of the agreement still applies. If the section about group lawsuits and jury trials is ruled unenforceable, then the entire arbitration agreement will be void.

No Waiver

If we don’t enforce a part of this agreement immediately, that doesn’t mean we waive our right to do so later.
